Planning permission has been refused for the development of 100 homes in Kirk Michael.
Heritage Homes wanted to build a new estate on land near Michael Primary School.
The proposal was opposed by some people when the Department of Education entered into a land swap deal with the developer, as a section of the school field at Douglas Road Corner was needed to create access.
In return, the school got a larger parcel of land.
An inspector turned down the plans on appeal and this has been backed by CoMin.
The Kirk Michael Local Plan says any development of that site should take into account the possibility of a by-pass route.
The inspector turned down the scheme both on its own merits and because road access should be determined once a firm decision is made about a by-pass.
